1. Acceptance
By using TopStudio3D CommerceOS, the user declares to have read and accepted these Terms and the Privacy Policy. Electronic acceptance, its date, version, and technical audit information may be recorded.
2. Account and Responsibilities
The user must provide accurate information, protect their credentials, and report suspicious access. They are responsible for the data, images, products, prices, and business decisions entered or made in their account.
3. Permitted Use
It is prohibited to use the service for fraud, intellectual property violations, child exploitation, illegal content, hate speech, weapons or illicit substances, system intrusion, malware distribution, or any activity contrary to the law. Violations may result in suspension, evidence preservation, and reporting to authorities when applicable.
3.1. Usage and Integrity Monitoring
To ensure platform security, proper resource utilization, and fraud and abuse prevention, the platform monitors usage and account health indicators, including access frequency, operation volume, AI processing failure rates, credit consumption, refund records, and workflow status. These indicators are used exclusively by administration for anomaly detection, rule-bypass prevention, and verification of contracted value delivery. Monitoring does not inspect the specific content of user data or materials, except when necessary for technical support requested by the holder themselves.
4. Third-Party Data
When registering customers, suppliers, or other data subjects, the user declares to have an adequate legal basis and to comply with their obligations as a Controller, including transparency, rights fulfillment, and data minimization.
5. Artificial Intelligence
AI features assist in content production and may present inaccuracies. The user must review results before using them. It is prohibited to submit unauthorized content, unnecessary sensitive data, or materials that violate third-party rights.
6. Plans, Credits, and Payments
Features may depend on subscription or credits. Prices, limits, and billing cycles are informed before hiring. Payments are processed by Stripe. Cancellation, renewal, and any refunds follow the conditions presented at hiring and applicable legislation.
7. Intellectual Property
The platform, brand, interface, and components remain protected by intellectual property rights. The user retains their rights over their own materials, granting only the authorization necessary to process them and deliver the service.
8. Availability and Security
We employ reasonable efforts to keep the service secure and available, but maintenance, third-party failures, and events beyond our control may cause interruptions. The user should keep copies of essential information and use the available export features.
9. Limitation of Liability
To the extent permitted by law, the platform is not liable for business decisions, user-posted content, external integrations, lost profits, or damages arising from improper use. This clause does not exclude liabilities that cannot be legally waived.
10. Suspension and Termination
The account may be suspended for security risk, non-payment, or violation of these Terms. The user may request termination and data deletion, subject to the mandatory retention periods described in the Privacy Policy.
11. Changes and Legislation
Material changes will be communicated and may require new acceptance. Brazilian laws apply, including the LGPD and the Consumer Defense Code when applicable. The competent jurisdiction will be defined according to legal consumer protection rules.
